New Enduring Powers of Attorney

A range of changes to the Guardianship and Administration Act 2000 and the Powers of Attorney Act 1998 came into effect on Monday 30 November 2020. A key change is that from 30 November 2020, new forms have been introduced for Enduring Powers of Attorney. The new forms are significantly different to the previous version of the forms.

While Enduring Powers of Attorney made before 30 November 2020 using the previous forms remain valid, it is essential to use the new Enduring Power of Attorney forms to make an Enduring Power of Attorney on or after 30 November 2020. Any Enduring Power of Attorney made using the previous forms on or after 30 November 2020 will be invalid.
