Following recent highly destructive weather events the question arises as to what the rights of a Buyer are when a property is damaged due to a weather event? It is important to remember that under the terms of the Queensland REIQ Contract the property is at the Buyer’s risk from 5pm on the first business day after the Contract is signed. Pursuant to the terms of a standard REIQ Contract time is only suspended where a party is unable to perform its settlement obligations because of a natural disaster.
