Your Rights as a Seller

One of the most meaningful financial decisions you’ll ever take will be to purchase, or sell a home. Buyers’ rights are generally made pretty clear, for example, the cooling-off period, and the right to have a building and pest inspection. But, what about when you’re selling a property? What rights do sellers have in Australia?

It’s always advised to seek the counsel of a conveyancing solicitor before signing any contract in order to feel secure in your choice and prevent any unnecessary expenses or complications. Selling your home should be as simple as purchasing it, and knowing your rights is paramount in any situation.

Selling your home

As a seller, you have the right to:

  • Choose who buys your property 
  • Sell your property without undue pressure from buyers 
  • Be paid a fair price for your property
  • Have a smooth and efficient settlement process. 

You also have consumer rights under the Australian Consumer Law, which apply to any contract you make with a real estate agent for the sale of your property. These rights include the right to:

  • Be treated fairly and reasonably 
  • Receive accurate and clear information 
  • Have any promised services provided in a professional way, and 
  • Not be misled or deceived about the services an agent can provide. 

As a seller, you must transfer full ownership to the purchaser. You must also provide vacant possession on settlement unless other arrangements have been made.
