Body Corporate Notices


Q. Is a Seller obliged to notify a Buyer of Body Corporate Notices?

A. Yes. The Seller must notify the Buyer of any notices of Body Corporate meetings and any resolutions passed at Body Corporate meetings after the Contract Date.  Where a Buyer is materially prejudiced by any resolution passed after the Contract date that is not disclosed in the Contract they may be able to terminate the Contract.

TIP – It is important for Sellers to continue to disclose these matters to the Buyer after the Contract date they can do this by providing this information to their Solicitor.
