Do you have a pool at the property you’re just about to sell? Do you have your Pool Compliance Certificate on hand? 

Sellers are required to provide the buyer with a Pool Compliance Certificate prior to settlement.

The new updates to the REIQ Contract have simplified the pool related provisions of the contract and a seller is now required to provide a Pool Compliance Certificate for a non-shared pool at or prior to settlement.

The only exception to this is if a “Notice of No Pool Safety Certificate” is given to the buyer prior to the contract being executed.

A failure to hand over the certificate at or prior to settlement will allow a buyer to terminate the contract. The seller should make enquiries with a pool safety inspector as early as possible to avoid issues with obtaining an inspection with enough time to obtain the certificate prior to settlement.
